The Legal Sphere

We would like to briefly inform you on the current legal development.

1) The government of the Czech Republic approved
new civil law regulations, consisting of the bill of new
Civil Code, Business Corporations Act and Act on
Private International Law. At the same time the
amendment of the Arbitration Act was approved by the
government. The bills shall be further discussed in the
Chamber of Deputies.

2) The articulated wording of the bill of the Act on
Pension Insurance and the Act on Supplementary
Pension Savings were presented by the government
of the Czech Republic for the amendment procedure.
Comments on both documents could have been raised
by 20 June 2011, the purpose of both bills being the
implementation of the announced and expected reform
of pension system. The aim would be to achieve the
long-term fiscal sustainability of the system while
strengthening the capital content as a source of income.

3) In recent days the new Civil Code legislation
governing the rental housing came into force.
Its purpose is to adapt the rules to achieve changes
in rent. In case of disagreement between the tenant
and landlord on the new amount of deregulated rent,
the valid legislation stipulates, that after 3 months
from the unsuccessful attempt to reach an agreement,
any of the parties may go to court with a motion
to determine the usual rent.
The difference is then settled retrospectively
as of the date of proposing the motion to the court.
In this context the Ministry for Regional Development
published on its website the unbinding information
database named Map of the Rent, the purpose of which
is to provide directory information for tenants and
landlords and thus prevent the lawsuits.

4) The bill by which the Court Fees Act No.
549/1991 Coll. and other relevant acts are being
amended and which introduces changes mainly
in the amount of court fees and the possibility of fee
exemption or fee return, was after the original rejection
of the Senate of the Parliament of the Czech Republic
approved by the Chamber of Deputies and presented
to president for signature on 23 June 2011.
