As of 1 January 2022, an amendment to Act No. 300/2008 Coll., on Electronic Acts and Authorised Conversion of Documents, came into force. It expands the so-called fiction of delivery also to private legal communication carried out via a data box. A document sent by a natural person, an entrepreneur or a legal person to the data box of another natural person, natural person engaged in business or legal person will thus be deemed to have been delivered on the tenth day following the day on which the document was delivered to the data box, pursuant to Section 18a(3) of the Act, even if the person who has access to the document does not log in to the data box. Thus, the same rules now apply for determining the time of delivery of public and private law documents via the data box.
