Global law firm DLA Piper has launched a new online tool to provide businesses with valuable insight into patent laws around the world.
Global Patent Laws highlights the key legal issues facing multinational businesses, and allows users to easily compare different countries’ patent laws and dispute resolution procedures. The tool offers a concise summary of the various approaches to patent infringement, preliminary injunctions, obtaining evidence, assessing validity, and the typical time to trial. Individual country guides and a full handbook are also available.
The resource was created by members of DLA Piper's patent practice. With more than 130 patent litigators in key jurisdictions, the firm is uniquely positioned to help companies successfully navigate patent matters around the globe.
"For companies operating in multiple countries, a strong awareness of the cross-border variations in patent laws is crucial,” said Robynne Sanders, a Melbourne-based partner and Global Co-Chair of DLA Piper's patent practice. “Effectively managing the risk of patent proceedings – and successfully bringing or defending these proceedings – can often depend on a strategic understanding of the differences between patent laws in different jurisdictions."
"Today, more than ever, patent litigation often involves multiple jurisdictions. In Europe, where sometimes various national parts of the same European patent are asserted in parallel, knowledge of the different national patent laws and their strategic use are key, said Dr. Markus Gampp, a Munich-based partner and Global Co-Chair of the patent practice. “Even while Europe strives for unification of the procedures for patent litigation with the upcoming Unitary Patent and the Unified Patent Court, differences in material patent laws will remain and form the basis on which judges will construe and interpret the applicable laws. We are thrilled to launch Global Patent Laws, which provides quick access to an excellent source of information on all key patent law topics."
“As technology continues to transform almost every industry and develop at an increasingly rapid pace, keeping up with patent and IP issues is imperative to the success of businesses in the US and around the world,” said Mark Fowler, a Silicon Valley-based partner and Global Co-Chair and US Chair of Patent Litigation. “Combined with the counsel of our experienced lawyers on the ground in virtually all major patent jurisdictions around the globe, Global Patent Laws will help our clients to navigate these complex patent issues and opportunities.”
